1. Acceptance of Terms

By accessing or using PropJournal ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PropJournal is a web-based trading journal, analytics, and compliance monitoring tool. The Service provides:

• Trade logging and analytics for forex, futures, stocks, commodities, cryptocurrency, and other financial instruments

• Prop firm compliance monitoring (drawdown tracking, consistency rules, profit targets)

• Personal risk management tools (custom loss limits, risk rules, position tracking)

• AI-powered trade analysis and pattern recognition

• Alert notifications via Telegram and email

The Service is provided "as is" and "as available" without warranties of any kind.

3. NOT Investment Advice

IMPORTANT: PropJournal does NOT provide investment advice, trading signals, recommendations to buy or sell any financial instrument (including but not limited to forex, futures, stocks, commodities, cryptocurrencies, options, or CFDs), or any form of financial advisory services. PropJournal is NOT a registered investment adviser, broker-dealer, commodity trading adviser, or financial planner in any jurisdiction.

All AI-generated insights, analytics, statistics, compliance alerts, and other outputs are for educational and informational purposes only. They are based on statistical analysis of YOUR historical trade data and do NOT constitute advice to take or avoid any specific trading action in any market.

You are solely responsible for your own trading decisions across all asset classes and markets. PropJournal and its creators shall not be held liable for any trading losses, failed challenges, or financial damages resulting from the use of this Service.

4. Compliance Monitoring Disclaimer

PropJournal's compliance monitoring feature is a best-effort tool designed to help you track adherence to prop firm rules or your own personal risk parameters. However:

• Compliance calculations are based on the trade data YOU provide. If your imported data is incomplete, incorrect, or delayed, compliance readings may be inaccurate.

• PropJournal does NOT have direct access to your broker, exchange, or prop firm account. Real-time data depends on when you import trades.

• Prop firm rules and exchange policies may change at any time without notice to us. We cannot guarantee that our rule configurations match the exact current rules of any firm or exchange.

• PropJournal is NOT affiliated with, endorsed by, or in partnership with any proprietary trading firm, broker, or cryptocurrency exchange.

• You are solely responsible for verifying your compliance directly with your prop firm, broker, or exchange.

5. AI-Generated Content Disclaimer

The AI Coach feature uses artificial intelligence to analyze your trade data across any asset class. AI-generated content:

• May contain errors, inaccuracies, or incomplete analysis.

• Is based on statistical patterns in YOUR data and does NOT predict future market movements in any market.

• Should be treated as one data point among many, not as authoritative guidance.

• Does NOT account for market conditions, news events, regulatory changes, or factors outside your historical trade data.

• Is NOT a substitute for professional financial, legal, or tax advice.

6. Cryptocurrency-Specific Provisions

If you use PropJournal to track cryptocurrency trades, you additionally acknowledge that:

• Cryptocurrency markets are extremely volatile and operate 24/7 without circuit breakers.

• Cryptocurrency may be subject to regulatory changes that can affect legality, tax treatment, or access in your jurisdiction.

• PropJournal does NOT custody, hold, transfer, or have access to any cryptocurrency assets.

• PropJournal is NOT a cryptocurrency exchange, wallet, custodian, or money services business.

• You are solely responsible for tax reporting on cryptocurrency gains/losses in your jurisdiction.

7. User Responsibilities

You agree to:

• Provide accurate account information and keep it up to date.

• Use the Service only for lawful purposes and in compliance with applicable laws in your jurisdiction.

• Not attempt to reverse-engineer, decompile, or interfere with the Service.

• Not share your account credentials with third parties.

• Not upload malicious files or content.

• Verify all compliance information independently with your prop firm, broker, or exchange.

• Comply with all applicable trading regulations, tax laws, and financial reporting requirements in your jurisdiction.

8. Subscription and Payments

PropJournal offers free and paid subscription tiers. Paid subscriptions are billed monthly through Stripe. You may cancel your subscription at any time through the Settings page. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPJOURNAL AND ITS CREATORS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TRADING LOSSES (IN ANY ASSET CLASS OR MARKET), FAILED PROP FIRM CHALLENGES, CRYPTOCURRENCY LOSSES, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claims arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless PropJournal from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your trading activities in any market or asset class.

11. Intellectual Property

The Service, including its design, code, features, and content, is owned by PropJournal. Your trade data remains yours. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. You may delete your account at any time by contacting us.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
